The ability of the Southeast Tennessee area to supply ample labor to industry is enhanced by an excellent rural road system and a moderate climate. These two factors allow the employer to draw labor from a wider geographic area. 2. Exemptions:

Employers with fewer than 5 employees

" Domestic workers are exempt. Employer may provide voluntary coverage.
" Agricultural workers are exempt.

3. Type of Insurance Requirements for Private Employment:


Compulsory, waivers permitted, competitive state fund, may self-insure through private carrier, individual employer or group employers.

4. Penalty Provisions for Uninsured Employers:

A fine of $10 to $100 and after conviction, fine is $1 to $10 for each day of noncompliance.


5. "Contractor-Under" Statutes (Principal Employer is liable for payment of compensation to employees of contractors & sub-contractors: YES)

6. Time Limitations for Filing Claims:

The right to compensations shall be forever barred, unless within one year after the accident resulting in injury or death occurred, the notice required is given to the employer and a claim for compensation is filed with the tribunal having jurisdiction to hear and determine the matter unless voluntary payments of compensation are paid to the injured person or his dependents. The right to compensation for occupational disease shall be forever barred unless suit thereof is commenced within one year after the beginning of the incapacity for work resulting from a occupational disease, and if death results from the occupational disease, unless a suit therefore be commenced within one year thereafter. A claim for benefits or death due to coal workers' pneumoconiosis shall be timely filed as such claim is filed within three years of the discovery of total disability or the date of such death, as the case may be.

8. Participation of Chiropractors:

Yes. No restrictions. Probative value of evidence is judicial decision.

9. Attorney's Fees:

Established by statute: 20% No statutory provisions whereby attorney fees are added to award in certain cases. Laypersons are not permitted to represent claimant. Attorney fees do become liens against awards.

10. Choice of Physician:

Employee chooses physician from list maintained by employer.
